On insolvency ,insolvent can go to court and explain that he list liney because of misfortune like earthquake etc so please relive him of unpaid liabilities , leaving some assets for personal use and give him misfortune certificate. This is calle getting discharged with misfortune certificate.
If he doenst go to court or when case is pending , he is called undischanrged insolvent.
