Assumption 1 (he has not left old firm, so common partner situation arises) (Popular Assumption)
if partner joins new firm before new firm is appointed then disqualified.
if partner joins after wards all fine.
because if common partner situation is on the date of appointment then disqualified.  

Assumption 2 (he left old firm)
if he was signing partner in old firm then form will get ineligible because of rotation rules.
if he was not signing partner then absolutely fine.
