if common partner situation arises after appointment then it is absolutely fine as per section 139(2), law thinks if on date of the appointment there is no common partner situation that means there is no intention to by pass law and if it happens afterwards they are ok with it. i understand same person may do audit, but yes this is loop hole in law. 
there is risk also, after appointment new firm may not absorb ca has common partner
